Flat fees

How every flat fee works, on one page

A flat fee covers our work on one case from the agreement to a plea, a dismissal or a trial date. It doesn't change if the case takes more hours than we expected. The charge and the court set which fee applies.

  • Misdemeanor or first DUI

One charge in county or municipal court: a first DUI, petty theft, simple possession, a minor assault. Paid in three parts over 60 days.

    • Video meetings whenever you need one

    • Every court date or hearing in the case

    • Discovery requested and read, video included

    • A written case plan after the first review

    • Motions to suppress written and argued

    • The license hearing, on a DUI

  • Felony, up to trial

One felony case in district court, from the first appearance through the preliminary hearing, motions and plea talks. Paid in four parts over 90 days.

    • Video meetings whenever you need one

    • Every court date or hearing in the case

    • Discovery requested and read, video included

    • A written case plan after the first review

    • Preliminary hearing prepared and argued

    • Motions to suppress written and argued

    • An investigator for one scene visit and two interviews

  • Record sealing

One petition to seal an arrest or conviction record that the law allows you to seal. Paid in full when you sign.

    • Eligibility checked and the petition filed

    • The hearing, if the court sets one

    • Video meetings whenever you need one

Our fees pay for legal work. Court filing fees, lab retests, expert witnesses, transcripts and bond are costs paid to others, and we name each one with its amount before it's spent. A trial is quoted as its own flat fee once a trial date is set.

Before you sign

The first call picks the fee

Fifteen minutes on video, at no charge. We ask what the charge is and when the next court date is, tell you which fee applies, and send the agreement if you want to go ahead. If your case doesn't fit any line on this page, we quote it in writing before you pay.

  • The fee and the payment dates, in the agreement

  • Costs named with their amounts before they're spent

  • A trial quoted separately, only if one is set

How the money works

When do I pay?

The first payment when you sign, and the rest on dates in the agreement. Misdemeanors are three payments over 60 days, felonies four over 90.

What if my case ends early?

A flat fee is earned in stages written into the agreement. If a case ends at an early stage, the agreement says what part of the fee is refunded.

What if I'm charged with more than one thing?

Charges from the same incident are one case and one fee. Separate incidents are separate cases, and we'll quote each before you sign.

Do you take cards?

Yes, cards and bank transfers. A card payment shows on your statement as Abernathy & Lisowski.
